Terms of Use

These Terms govern use of MediCare+, a product of SquareML Inc.. By using MediCare+, you agree to these Terms and the Privacy Policy.

1. The service

MediCare+ is software for clinics to run the visit: in-clinic and online appointments, Health ID and records, follow-up, notices, campaigns that become bookings, and payments for online consults. SquareML provides the software. Clinical advice comes from the licensed clinicians in your clinic. Confirm suggestions in the app with your doctor.

2. Not a medical device

MediCare+ is not a medical device and does not diagnose, treat, cure, or prevent any medical condition. Health details and suggestions in the app are entered by people for you and your doctor to review together. Health ID can include an emergency contact. MediCare+ is not emergency care.

3. Accounts

Accounts are created by a clinic. You must keep credentials confidential. You must provide accurate information. The clinic may suspend access according to its policies. We may suspend access for abuse, security risk, or legal reasons.

4. Acceptable use

You may not: attempt to access other users' data without authorization; disrupt the service; use the video or chat features for unlawful content; scrape or reverse engineer the service except as allowed by law; or use MediCare+ to provide care you are not licensed to provide.

5. Payments

Consult fees may be collected through a payment processor or at the clinic. Fees are for a real-world visit with an identified clinician. SquareML is not the merchant of record for the clinical service unless a separate written agreement says so. Refunds follow clinic policy and the payment processor. These purchases are not App Store or Google Play in-app purchases.

6. Health information

You are responsible for the accuracy of information you enter. Clinicians and clinic staff may see information needed to provide the visit. Uploaded files may include sensitive health data; only upload what the clinic needs.

7. Video visits

A video visit is a scheduled one-to-one session. Camera and microphone access is required. Connection quality depends on your network. SquareML does not guarantee that a visit can be completed if the network, device permissions, or clinic systems fail.

8. Intellectual property

MediCare+, its design, and related trademarks are owned by SquareML or its licensors. You receive a limited, revocable right to use the app for the clinic service. You retain rights in content you upload, and you grant SquareML and the clinic a license to host and display that content to operate the service.

9. Disclaimer

THE SERVICE IS PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, SQUAREML DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SQUAREML DOES NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR CLINICAL OUTCOMES.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SQUAREML AND ITS AFFILIATES ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR CLINICAL OUTCOMES. SQUAREML'S TOTAL LIABILITY FOR CLAIMS RELATING TO THE SOFTWARE SHALL NOT EXCEED THE FEES PAID TO SQUAREML FOR THE SOFTWARE IN THE THREE MONTHS BEFORE THE CLAIM (EXCLUDING CLINIC CONSULT FEES PAID TO A CLINICIAN OR PROCESSOR).

Some jurisdictions do not allow certain limits; in those places, our liability is limited to the maximum extent permitted.

11. Termination and deletion

You or the clinic may stop using MediCare+ at any time. You may request account deletion as described at Delete account. Some records may be retained where law requires.

12. Governing law

These Terms are governed by the laws of the State of New Jersey, USA, excluding conflict-of-law rules, unless a mandatory local law in your place of residence says otherwise.
